Q. An employee is out on disability leave. The employee calls to request to come back to work, but only working nights and weekends. Does the employer have to accommodate this request?
A. It depends. The employer needs to ask if this is a restriction set forth by the employee’s doctor. If so, there needs to be appropriate documentation. The employer needs to determine if this is a reasonable accommodation based on their business. The employer is not required to make up a shift that did not previously exist for this employee.
If this request comes strictly from the employee who has no restrictions from their doctor, the employer is not obligated to change the employee’s shift.
