The New York State budget, which Governor Andrew Cuomo signed on April 13, 2018, contains new sexual harassment prevention requirements applicable to all New York employers.  Non-disclosure provisions in settlement agreements and  mandatory arbitration clauses for sexual harassment claims are prohibited effective July 11, 2018.  Mandatory annual sexual harassment training and written anti-harassment policy will be effective October 9, 2018.

The new laws will impose employer responsibilities and restrictions including: mandatory annual training, prohibitions on arbitration and confidentiality clauses, and specific policy requirements.
