That information may be governed by ESC’s agreements with its clients, applicable portal terms and notices, and the privacy practices of the applicable employer, plan sponsor, benefit carrier, administrator, or platform provider.

If you have questions about information ESC processes on behalf of your employer or another organization, you should generally contact that organization first.

5. Cookies and Similar Technologies.

ESC and its service providers may use cookies, pixels, tags, analytics tools, server logs, and similar technologies to operate and secure the Site, remember preferences, understand how visitors use the Site, improve functionality, measure performance, and support communications and marketing activities. These technologies may collect information such as IP address, browser and device type, operating system, referring page, pages viewed, links clicked, time spent on the Site, and other interactions. Some technologies are necessary for Site operation and security. Others may support analytics, embedded content, measurement, advertising, or marketing. Depending on applicable law and the technologies used on the Site, you may be able to manage nonessential cookies through a cookie banner, privacy-preference tool, browser settings, or device settings. Disabling certain technologies may affect Site functionality. Third-party providers may also collect information through the Site in accordance with their own privacy policies. 6. How We Disclose Personal Information.

ESC may disclose personal information:

  • to affiliates and related entities for the purposes described in this Privacy Policy;

  • to other parties at your direction, with your consent, or as otherwise disclosed when the information is collected.

ESC does not sell personal information in exchange for money. Certain disclosures involving analytics, advertising, or similar technologies may be treated as a “sale,” “sharing,” or targeted advertising under some state privacy laws, even when no money is exchanged. Where required by applicable law, ESC will provide appropriate notices and methods to exercise applicable opt-out rights.

7. Marketing Communications.

ESC may use contact and business information to respond to inquiries and provide service information, newsletters, event invitations, educational materials, and other communications. You may opt out of marketing emails by following the unsubscribe instructions included in the communication or by contacting ESC. Opting out of marketing communications will not prevent ESC from sending service-related, transactional, security, legal, or administrative communications. ESC may communicate by telephone or text message when you provide a telephone number, initiate the communication, request that method of communication, or otherwise consent. Message and data rates may apply. You may request that ESC stop sending text messages by replying “STOP,” where available, or by contacting ESC. ESC does not intend for the submission of a customer support inquiry, by itself, to constitute consent to receive unrelated marketing communications.

8. Data Security.

ESC maintains reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, acquisition, use, alteration, disclosure, or destruction. However, no website, communication method, network, or storage system is completely secure. ESC cannot guarantee the absolute security of personal information. You should not submit sensitive personal information through the public-facing Site, ordinary email, or another unsecured communication method unless ESC expressly directs you to do so.

9. Data Retention.

ESC retains personal information for as long as reasonably necessary to fulfill the purposes described in this Privacy Policy, maintain business records, comply with legal and contractual obligations, resolve disputes, enforce agreements, and protect ESC’s rights and operations. Retention periods vary depending on the nature of the information, the purpose for which it was collected, the applicable relationship, and legal or regulatory requirements. When personal information is no longer reasonably necessary, ESC may delete, deidentify, anonymize, or otherwise dispose of it in accordance with applicable law and ESC’s policies.
